Terms and Conditions
These Terms and Conditions (“Agreement”) govern the use of services provided by Thorough SoftWash (“We”, “Us”, or “Our”) for pressure washing and soft washing services (“Services”). By scheduling or accepting our services, you (“Client”, “You”, or “Your”) agree to be bound by these Terms and Conditions.
1. Services Provided. We offer residential and commercial pressure washing and soft washing services including but not limited to: Exterior home surface cleaning, Deck and Patio cleaning, Driveway and sidewalk cleaning, and other cleaning services upon request. Specific details will be outlined in the Service Agreement or quote provided.
2. Service Scheduling and Cancellations. Booking: Services requests can be made via phone, email, or our website. A scheduled appointment will be confirmed once the quote is received and approved. Cancellation: Cancellations must be made at least 24 hours prior to the scheduled service. If a cancellation occurs after this period, a cancellation fee of $75 dollars may apply. Rescheduling: Rescheduling requests must be made at least 24 hours in advance. We reserve the right to reschedule appointments in the event of inclement weather or unforeseen circumstances.
3. Pricing and Payment. Pricing: Pricing for services will be provided in advance via quote. Any changes to the scope of work after the initial quote will require a new quote and potential price adjustment. Payment: Payment for services is due upon completion of the work unless otherwise agreed upon. We accept payment via cash, credit card, or other agreed-upon methods such as Paypal. Late Fees: Any unpaid balance after 30 days may incur a late fee of $150 per month on the outstanding balance.
4. Client Responsibilities. Access: You agree to provide clear access to the areas to be cleaned. This includes ensuring that gates, doors, or other barriers are unlocked and that no vehicles or obstacles obstruct the work area. Utilities: You agree to provide access to water and electricity (if necessary) for the performance of the services. Damages: You are responsible for ensuring that delicate or valuable items are removed from the cleaning area. We are not liable for any damage to items left in the work area unless caused by negligence. Pre-existing Conditions: You acknowledge that pressure washing and soft washing may not remove all stains, especially those that have been present for an extended period of time. We are not liable for any stains or damages caused by pre-existing conditions.
5. Our Responsibilities. Equipment and Materials: We will provide all necessary equipment, cleaning agents, and materials to perform the services in a professional and efficient manner. Damage Liability: We are fully insured and will take all reasonable precautions to avoid damaging your property. However, we are not responsible for pre-existing damage or damages caused by hazards beyond our control (e.g. hidden structural issues, faulty equipment, etc.)
6. Limitation of Liability. We are not responsible for incidental, indirect, or consequential damages, including but not limited to property damage, loss of profits, or personal injury, except where the damage was caused by our negligence. In no event will our total liability exceed the amount you paid for the services provided.
7. Weather and Delays. We reserve the right to delay or reschedule services due to adverse weather conditions, including but not limited to heavy rain, high winds, or freezing temperatures. In such cases, we will notify you as soon as possible to reschedule the appointment.
8. Health and Safety. All services will be performed in compliance with safety standards and regulations. You agree to take appropriate precautions to ensure the safety of children, pets, and any other individuals during the cleaning process. We will not be held responsible for any injuries or health issues arising from improper precautions taken by you during or after the services.
9. Indemnification. You agree to indemnify, defend, and hold harmless Thorough SoftWash, its employees, contractors, and agents from and against any claims, losses, liabilities, or damages arising from your actions, omissions, or failure to comply with these Terms and Conditions.
10. Termination. Either party may terminate this Agreement with written notice if the other party breaches any material terms of this Agreement. Upon termination, you will remain responsible for payment of services rendered up until the termination date.
11. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the state of Washington (WA) without regard to its conflict of law principles.
12. Dispute Resolution. In the event of a dispute, both parties agree to first attempt to resolve the issue through informal negotiation. If unresolved, the dispute will be submitted to binding arbitration under RCW 11.96A.310.
13. Amendments. We reserve the right to update or amend these Terms and Conditions at any time. Any changes will be posted on our website and will become effective immediately upon posting.
